Nothing in this section prevents either party from bringing an eligible individual matter in small claims court.

Nothing in this section prevents a party from requesting temporary or injunctive relief from a court where reasonably necessary to protect intellectual property rights or prevent imminent unlawful conduct.

34 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND AMAZING MAGIC WORLD TRADING INC AGREE THAT CLAIMS SUBJECT TO ARBITRATION WILL BE BROUGHT ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

An arbitrator may not consolidate claims of multiple individuals except where all affected parties expressly agree or applicable law requires otherwise.

If applicable law prohibits enforcement of this waiver with respect to a particular claim or remedy, that portion of the dispute will be handled as required by applicable law.

35 Right to Opt Out of Arbitration

However, nothing in this section eliminates a consumer's non-waivable right to bring a claim in another jurisdiction where applicable law provides such a right.
